Welcome to the Home-Fix eStore currently accessible at http://www.home-fix.com/estore. These terms and conditions (Terms) govern all sales of Products by Home-Fix eStore to you. By purchasing any Product you are entering into a legally binding agreement with Home-Fix.
1. In these Terms the following words have the following meanings:
Business Day means any day excluding Saturdays, Sundays and public holidays in Singapore.
GST means any goods and services tax chargeable under the Goods and Services Tax Act (Cap.117A).
Order means any order for Products placed by you through the Site.
S$ means Singapore Dollars.
Home-Fix means Home-Fix D.I.Y Pte Ltd.
Products means the products which are available for purchase from the Site and a Product is any one of them.
2. Contract for sale
2.1 A binding agreement for Home-Fix to sell you Products is made on these Terms when Home-Fix accepts an Order in accordance with Clause 2.2.
2.2 Each Order placed by you with Home-Fix is only confirmed when Home-Fix sends you an email that confirms that the Products have been dispatched.
3. Order and Delivery
3.1 By placing an Order, you warrant that you are: (i) legally capable of entering into binding contracts; and (ii) you are at least 18 years old.
3.2 Upon confirmation of payment, Home-Fix will contact you via email or phone to fix the delivery schdeule and dispatch the Products to the address that you specify for delivery in the Order. Home-Fix will try to deliver within the the quoted timeframe but such timeframe is an estimate only based on availability, normal processing and delivery companies. Accordingly Home-Fix will not be responsible for any delay in delivery. Depending on product availability, delivery usually takes 2-5 working days. In peak seasons, delivery can take up to 7 working days.
3.3 You agree that subject to availability of Products, Home-Fix reserves the right to deliver the Products in instalments.
3.4 The Products are at your risk until delivery. Ownership of the Products will only pass to you when Home-Fix receives full payment including delivery charges (where applicable).
4. Price and Payment
4.1 Delivery charges are priced at S$10.70 per trip and is Free for orders above S$200. Delivery charges does not include installations or any other services other than the product itself.
4.2 All prices are specified in S$, and include GST within Singapore. Delivery of Products to delivery addresses outside of Singapore will attract international shipping charges and may be subject to taxes, customs duties and fees levied by the destination country (Import Fees).
4.3 Prices are subject to change at any time but changes will not affect any Order that Home-Fix has accepted.
4.4 You may make payment for Products by:
(i) credit card, processed securely through PayPal. Any payment processed through PayPal is subject further to PayPal’s prevailing terms and conditions currently accessible at https://www.paypal.com/sg
5. Defective or Damaged Products
5.1 Except for Products that are defective or damaged upon delivery to you, all Products cannot be returned or exchanged.
5.2 If you receive a defective or damaged Product, you must notify Home-Fix in accordance with Clause 9 within 7 days after the day following the delivery of the Product, after which Home-Fix shall have no liability to you. Home-Fix's obligation to you in respect of such notification will be at its option to: (i) replace any Product that is defective or damaged; or (ii) refund to you the amount paid by you for the relevant Product to the original method of payment.
6. Liability and Disclaimer
6.1 To the extent permitted by law, Home-Fix makes no warranty or representation that any Product will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, or that it will not infringe the rights of third parties.
6.2 Home-Fix will not be liable to you for any indirect or consequential loss or damage arising out of any Order, however caused, even if foreseeable.
6.3 Nothing in these Terms excludes or restricts Home-Fix's liability for death or personal injury caused by its negligence or for any matter for which it would be illegal for it to exclude its liability.
7. Matters out of Home-Fix's Control
7.1 Home-Fix will not be liable or responsible for any failure to deliver Products you ordered that is caused by any event outside its reasonable control (Force Majeure Event).
7.2 Home-Fix's performance under these Terms is deemed to be suspended for the period that the Force Majeure Event continues, and Home-Fix will have an extension of time for performance for the duration of that period.
8. Intellectual Property
8.1 The Products are subject to copyright laws and protection and are sold to you on the basis that you comply with the provisions of any copyright notices thereon and therein. Under no circumstances shall SingHealth be liable to you for any of your actions which are in breach of such copyright laws and provisions.
8.2 You acknowledge that all trade marks, logos and other intellectual property rights used as part of the Site belongs to Home-Fix or another party. No person or entity may reproduce or use such trade marks, logos or intellectual property in any manner other than expressly authorised by Home-Fix or the relevant third party.
10. Governing law and Disputes
10.1 Singapore law, without regard to principles of conflict of laws, will govern these Terms.
10.2 In any claim or action by or against you directly or indirectly arising under these Terms, you agree to submit to the jurisdiction of the Singapore courts.
11.1 Home-Fix may amend these Terms from time to time by posting revised terms on the Site, which shall apply to all Orders placed after such date.
11.2 If any of these Terms is held invalid, the remainder of these Terms shall continue in full force and effect. If any Term shall be deemed unlawful, void or for any reason unenforceable, then that Term shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining Terms.
11.3 The failure of Home-Fix to exercise or enforce any of these Terms shall not constitute a waiver of such right or provision in that or any other instance.
